Union calls on Labor for increased protections for food delivery riders

The Transport Workers Union is calling on the NSW Labor Party to introduce increased protections for food delivery riders.

The union will put the motion forward at this weekend’s party conference in Sydney.

The motion proposes a change to the NSW Industrial Relations Act to include food delivery riders and also people who deliver bread, milk and cream.

The relevant part of the Act is called Chapter 6.

Currently, owner driver contractors are denied minimum rates of pay in addition to unfair dismissal rights.

The TWU wants food delivery riders and also people who deliver bread, milk and cream to no longer be exempt from those protections.

TWU national secretary Tony Sheldon said:

“The legislation, contained in Chapter 6 of the Industrial Relations Act, ensures independent contractors have the right to seek minimum rates, conditions and also access to the Industrial Relations Commission to resolve disputes like unfair dismissal.”

More protections needed

Miles Heffernan, Director of Litigation at Industrial Relations Claims, supports the move to increase protections for gig economy workers.

“Food delivery riders struggle when it comes to earning a living wage,” he said.

“Additionally, they miss out on holiday pay and sick pay and superannuation, and the right to claim unfair dismissal.

“Currently it is too easy for employers to misclassify workers as independent contractors instead of employees, so they can get out of paying proper wages and entitlements.

“Any changes that result in greater protections for gig economy workers is a good thing.”
