Industrial Relations Claims negotiates $70,000 payout for medical staff

Industrial Relations Claims has negotiated $70,000 compensation for two medical staff who were owed 15 years of entitlements.

When the boss sold the business, the new owner initially refused to pay the workers’ accrued leave and superannuation.

The two women worked at the Brisbane medical business for more than a decade.

In that time, it had many different owners.

The most recent owner told the workers they will only receive their long service and redundancy entitlements for a period of three years.

As a result, the women lost their accrued long service leave, and their redundancy payments reduced to just a few weeks, effectively robbing them of tens of thousands of dollars each.

IR Claims took on the case, demanding the company hand over 15 years of employment records for the women.

Director of Litigation Miles Heffernan says it’s unlawful for an employer to refuse to hand over employment documentation.

“The Fair Work Act has a provision that an individual can request all of their employment records,” he said.

“And not just for the past six years, but forever.”

Like ‘corporate spaghetti’

As a result of the business changing hands so many times, IR Claims found it difficult to find out where money had been put aside for the women’s entitlements.

“It was a massive corporate structure – like corporate spaghetti – with owners and directors and sellers and buyers and family trusts,” Mr Heffernan said.

“We advocated with all the parties, which involved 16 entities in total, with all of them pointing the finger at each other.

“Thankfully, our skilful analysts managed to unwind all of the players and track down the funds.”

IR Claims threatened criminal action

Meanwhile, Mr Heffernan said his clients feel “delighted” with the result.

“If I was to quote one of them, ‘we couldn’t get through the greasy snake oil salesmen, only you could’,” he said.

“These will be the last cheques these ladies get before retirement, so in that sense, it’s truly touching.  

“It’s just a shame that we had to be the ones to make it happen.”
